Terms of Service

1. What Noqu Vale is

Noqu Vale builds and hosts a website for your business. You describe your business to our friendly AI waiter, we generate a complete site, and you can refine it by conversation. Your plan is an annual (12-month) subscription that includes hosting, a web address, and a set allowance of AI edits (“coconuts”).

2. Billing and renewal

Plans are prepaid for a 12-month term, charged in full at signup. We accept payment by card, PayPal, and M-PAiSA. Prices are shown in Fijian dollars (FJD) or, for customers outside Fiji, in US dollars (USD).

Nothing auto-charges. We email you before your term ends (typically at the 3-month, 6-month and final 30-day marks). Renew on time for the standard price; a small surcharge applies to late renewals. If you do not renew, your subscription and the services attached to it end at expiry.

3. Acceptable use

You agree not to use Noqu Vale to:

• publish unlawful, misleading, or infringing content;
• impersonate another person or business, or misrepresent your affiliation;
• distribute malware, spam, or attempt to disrupt or probe our systems;
• resell or sublicense the service without our written consent.

We may suspend or remove content, or suspend an account, that breaches these Terms or Fiji law. Where practical we will contact you first.

4. Your content and ownership

You own the content you provide and the website we build for you. You grant us the limited licence needed to host, display, back up, and edit your site so we can provide the service. On the Growth plan you can export your site’s source to your own GitHub account at any time, so your work is never locked in.

We own the Noqu Vale platform, software, and branding. Nothing in these Terms transfers our intellectual property to you.

5. Domains

Where your plan includes a custom web address, we register and renew the domain on your behalf for as long as your subscription is active. If you cancel or do not renew, we will on request transfer the domain out to a registrar of your choice at no charge, subject to normal registry transfer rules. Domain registration is governed by the relevant registry and registrar terms in addition to these Terms.

6. Concierge editing consent

To help you get the best result, you authorise Noqu Vale staff to view and edit your site on your behalf — for example, to fix an issue, apply a change you asked for, or polish your site before launch. We log every change our staff make and show it in your dashboard so you always have a record of what was done and when.

You can opt out of concierge editing at any time in your Account settings. Opting out means our staff will not make edits for you, though you may still ask us to help by re-enabling it.

7. Refunds and cancellation

Annual plans are prepaid and, other than the credit-refund window described in our Refund & Cancellation policy, are non-refundable. See that policy for how to cancel and what happens to your site and domain.

8. Disclaimers and liability

The service is provided “as is”. We work hard to keep it available and accurate but do not warrant that it will be uninterrupted or error-free. To the extent permitted by law, our total liability arising from the service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential loss.

9. Governing law

These Terms are governed by the laws of Fiji, and you submit to the exclusive jurisdiction of the courts of Fiji.
